General terms and conditions of sale (AGB) for orders placed through the éepa online shop.

1. Scope and contracting party
These Terms & Conditions apply to all orders placed through the éepa online shop at eepa.coffee.
Contracting party is éepa coffee e.U., Registered business address, Vienna, 1010 Vienna, Austria ("éepa", "we", "us").
By placing an order you confirm that you are at least 18 years old and accept these Terms & Conditions.
2. Products and product information
We sell specialty Colombian coffee roasted in Vienna. Products are offered as whole-bean coffee in packs of 250g (8.8 oz) unless otherwise stated on the product page.
Product images and descriptions are provided as accurately as possible. Minor variations in packaging or batch characteristics may occur without affecting product quality.
3. Contract formation
Product listings on our website constitute a non-binding invitation to order.
When you complete checkout and we receive your order, you submit a binding offer to purchase the selected products.
A contract is formed when we confirm the order by email or when we dispatch the goods, whichever occurs first.
We may decline an order in cases of obvious pricing errors, unavailable stock, suspected fraud, or delivery restrictions.
4. Prices, taxes, and payment
All prices shown in the shop are in the currency indicated at checkout and include applicable statutory value-added tax (VAT) where required.
Shipping costs, if any, are shown before you complete payment.
Promotional codes or wheel discounts apply only under the conditions stated at the time of the offer and within any stated validity period.
Payment is processed securely via Stripe. We accept the payment methods displayed at checkout. The contract price is due at the time of order.
5. Delivery and risk
We ship to addresses within the delivery regions offered at checkout.
Unless otherwise stated, orders are dispatched within 48 hours on business days after payment confirmation.
Estimated delivery times depend on the carrier and destination and are not guaranteed unless expressly agreed in writing.
Risk of loss or damage passes to you upon delivery to the address you provide or to a person authorised to receive the shipment.
If delivery fails due to incorrect or incomplete address details provided by you, additional shipping costs may be charged.
6. Right of withdrawal (consumers)
If you are a consumer within the meaning of Austrian and EU consumer law, you have the right to withdraw from this contract within 14 days without giving reasons.
The withdrawal period is 14 days from the day on which you or a third party named by you, other than the carrier, takes physical possession of the goods.
To exercise the right of withdrawal, you must inform us of your decision by a clear statement (e.g. email to hello@eepa.coffee). You may use the model withdrawal form below, but it is not obligatory.
If you withdraw from the contract, we will reimburse all payments received from you, including delivery costs (except additional costs arising from your choice of a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the day we receive notice of withdrawal. We use the same payment method you used for the original transaction unless otherwise agreed.
You must send back the goods without undue delay and in any event no later than 14 days from the day you communicate withdrawal. You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
The right of withdrawal may not apply to sealed goods that are not suitable for return due to health protection or hygiene reasons if the seal has been removed after delivery, or to other cases permitted by applicable law.

7. Statutory warranty and complaints
Statutory warranty rights apply to consumers under Austrian law. You are entitled to remedy for defective goods in accordance with applicable consumer protection rules.
Please inspect products upon receipt and contact us promptly at hello@eepa.coffee if goods arrive damaged, incorrect, or defective. Please include your order number and, where possible, photos of the issue.
Voluntary guarantees, if any, are described separately on the product or promotion page and do not limit your statutory rights.
8. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and under mandatory product liability law.
For slight negligence we are liable only for breach of essential contractual obligations (cardinal duties), and then only for the foreseeable damage typical for this type of contract.
Apart from the above, our liability is excluded to the extent permitted by law.
These limitations also apply in favour of our legal representatives and vicarious agents.
9. Data protection
We process personal data necessary to perform the contract, process payment, and deliver your order. Further information on data processing will be provided in our Privacy Policy when published.

10. Dispute resolution and governing law
The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.
For consumers resident in the EU, mandatory consumer protection provisions of the country of residence remain unaffected where applicable.
These Terms & Conditions and the contractual relationship are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG), unless mandatory consumer protection rules provide otherwise.
If you are a merchant, the exclusive place of jurisdiction is Vienna, Austria. For consumers, jurisdiction follows mandatory statutory rules.
11. Final provisions
If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions remain in effect.
We may update these Terms & Conditions from time to time. The version published at the time of your order applies to that order.
